Terms of Service

Please read these Terms of Service carefully before using ForensicPrep. By creating an account or using the service, you agree to be bound by these terms.

Acceptance of terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you") and Waypoint Psychology, operated by Zackery A. Tedder, PsyD ("Waypoint Psychology," "we," "us"), governing your access to and use of ForensicPrep at forensicprep.app ("Service").

By accessing or using the Service, you represent that you are at least 18 years of age, have the legal capacity to enter into this agreement, and agree to be bound by these Terms and our Privacy Policy. If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that organization.

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email. Continued use of the Service after changes constitutes acceptance.

Description of service

ForensicPrep is an AI-powered professional training platform that simulates adversarial legal proceedings, including cross-examination, direct examination, Daubert/Frye challenges, and depositions, for licensed and training mental health professionals. The Service generates attorney simulations, provides performance scoring via the Forensic Testimony Competency Index (FTCI), produces annotated session transcripts, and integrates federal case law research via CourtListener.

ForensicPrep is a training and educational tool. It does not constitute legal advice, clinical supervision, or professional consultation of any kind. Simulated attorney questioning is generated by artificial intelligence and is intended for educational preparation only. It does not represent the opinions or strategies of any real attorney, court, or legal proceeding.

Eligibility and professional use

ForensicPrep is designed for:

  • Licensed mental health professionals including psychologists, psychiatrists, licensed clinical social workers, and related disciplines.
  • Graduate students and postdoctoral trainees in supervised professional training programs.
  • Training directors and program administrators using the Service for curriculum purposes.

Use of the Service by individuals outside these categories is permitted but the Service is optimized for and marketed to the professional mental health community. We reserve the right to terminate accounts that appear to misuse the professional training context.

Acceptable use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Enter actual patient, client, or third-party identifying information, protected health information, or confidential case data into the Service.
  • Use the Service to prepare for actual legal proceedings in a manner that substitutes for qualified legal counsel.
  • Attempt to reverse-engineer, decompile, or extract the underlying AI models, system prompts, or proprietary scoring frameworks.
  • Share your account credentials or allow others to access the Service using your account.
  • Use the Service to generate content intended to harass, defame, or harm any individual.
  • Attempt to circumvent subscription access controls or use the Service beyond the scope of your paid plan.
  • Resell, sublicense, or commercially distribute outputs from the Service without written permission.
  • Use automated tools, bots, or scrapers to access the Service.

Violation of these acceptable use provisions may result in immediate account termination without refund.

Confidentiality and professional responsibility

You are solely responsible for ensuring that your use of the Service complies with your professional licensing obligations, ethical codes, and applicable confidentiality requirements.

ForensicPrep is not a HIPAA Business Associate and does not execute Business Associate Agreements. Do not enter real patient or client information into the Service. Use anonymized, hypothetical, or composite scenarios in all case context fields.

Session content you enter is transmitted to Anthropic's API for AI processing. You acknowledge that entering confidential professional information into the Service may constitute a confidentiality breach under applicable professional codes. This responsibility rests solely with you.

Subscription and payment

Access to ForensicPrep requires a paid subscription. Subscriptions are billed monthly through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

  • Free trial: New accounts receive a 14-day free trial. No charge is made until the trial period ends. You may cancel at any time during the trial without charge.
  • Monthly subscription: After the trial, subscriptions are billed monthly at the then-current rate. Current pricing is displayed at forensicprep.app/pricing.
  • Session packs: We offer one-time session pack purchases (3, 10, or 30 sessions) that do not require a subscription. Session packs are non-refundable and do not expire. Session credits are added to your account upon confirmed payment.
  • Cancellation: You may cancel your subscription at any time through the billing portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused portions of a billing period.
  • Refunds: We do not offer refunds except where required by applicable law or at our sole discretion in cases of documented technical failure preventing access to the Service.
  • Price changes: We reserve the right to change subscription and session pack pricing with 30 days advance notice to registered users.

Intellectual property

The Service, including its software, design, underlying AI prompts, the Forensic Testimony Competency Index (FTCI) framework, scoring methodologies, and all associated content, is owned by Waypoint Psychology and protected by applicable intellectual property laws.

You retain ownership of the content you enter into the Service, including your typed testimony responses and case context descriptions. You grant Waypoint Psychology a limited license to process and store this content solely to provide the Service.

Session transcripts, FTCI reports, feedback reports, and annotated transcript exports generated by the Service are provided for your personal professional development. You may use these outputs for personal training, supervision, and professional development purposes. You may not resell, publish, or commercially distribute these outputs without written permission.

The ForensicPrep name, logo, and brand marks are property of Waypoint Psychology. You may not use them without written permission.

AI-generated content and limitations

ForensicPrep uses large language model AI to generate attorney simulations, scoring analyses, feedback reports, and transcript annotations. You acknowledge that:

  • AI-generated attorney questioning is simulated and educational. It does not represent actual legal strategy, guaranteed cross-examination approaches, or the conduct of any real attorney.
  • FTCI scores are generated by AI applying defined behavioral anchors to your transcript. They are training tools, not clinical assessments, professional evaluations, or legally defensible competency determinations.
  • AI outputs may contain errors, inconsistencies, or inaccuracies. You should apply professional judgment when interpreting all AI-generated feedback.
  • The Service does not guarantee that completing simulations will improve actual testimony performance or produce any specific professional outcome.
  • AI models may produce unexpected or occasionally inappropriate outputs. If you encounter such outputs, please report them to us.

Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities. We do not warrant that AI-generated content will be accurate, complete, or appropriate for any specific purpose.

We make no representation that use of the Service will prepare you for any specific legal proceeding, improve your actual testimony performance, satisfy any licensing or continuing education requirement, or meet any standard of professional competency.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYPOINT PSYCHOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim. This limitation applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Waypoint Psychology and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your violation of these Terms, your violation of any applicable law or professional obligation, or your entry of confidential or protected information into the Service.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that we determine in our sole discretion is harmful to other users or to the Service.

You may terminate your account at any time by canceling your subscription and contacting us to request account deletion. Upon termination, your right to access the Service ceases immediately. Data deletion is handled as described in our Privacy Policy.

Provisions of these Terms that by their nature should survive termination, including intellectual property, disclaimer of warranties, limitation of liability, and indemnification, shall survive.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hays County, Texas, and you consent to personal jurisdiction in those courts.

Before initiating formal legal proceedings, you agree to contact us at the address below to attempt informal resolution. We will attempt to resolve disputes informally within 30 days of notice.

Miscellaneous

  • Entire agreement: These Terms and our Privacy Policy constitute the entire agreement between you and Waypoint Psychology regarding the Service and supersede all prior agreements.
  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.
  • Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
  • Force majeure: We are not liable for failures or delays caused by circumstances beyond our reasonable control, including AI provider outages, infrastructure failures, or natural disasters.
